California Supreme Court issues opinion in Prop.8 defense case

The California Supreme Court issued an opinion today (11/17/11), which is several weeks earlier than the deadline, stating unanimously that the official proponents have a legal right to defend Prop.8 when the state refuses to do so. The proponents include protectmarriage.com and the 4 individual proponents (see subscript 6 at the bottom of page 11 in the PDF in the link below).
Neither the Governor, the Attorney General, nor any other executive or legislative official has the authority to veto or invalidate an initiative measure that has been approved by the voters. pp.5
It is now up to the Ninth Circuit to decide whether or not to accept the California Supreme Court's opinion in this matter. They are not required to accept this opinion.
