2nd Circuit rules DOMA unconstitutional

On 10/23/12 the second circuit ruled that the federal government's DOMA is unconstitutional since homosexuality is a suspect class.  ADF ref, pdf  

A) homosexuals as a group have historically endured persecution and discrimination;
B) homosexuality has no relation to aptitude or ability to contribute to society;
C) homosexuals are a discernible group with non–obvious distinguishing characteristics, especially in the subset of those who enter same–sex marriages; and
D) the class remains a politically weakened minority.

I very much disagree on most of those points and so does the U.S. Supreme Court.

A) false.  
B) I don't understand.  
C) homosexuality is a behavior, not an ethnicity.  
D) they are the most powerful political entity in the world!

Update 10/29/12: The U.S. Supreme Court will likely announce what same sex cases it will hear on November 26, 2012 9:30am EST. ref

Update 11/14/12: The date for the consideration of what marriage cases the Supreme Court will hear has been moved to 11/30/12 from 11/20/12.  I have not discovered when they will announce which cases they will hear.  ref
