What Arizona's SB 1062 really says
Posted: 2/21/14
Arizona's SB 1062 bill is titled "
exercise of religion; state action." Almost every other news article I have read on this bill and others like it have articles titled
It then dawned on me that I should see
what this bill really says.
5. Requires a person who asserts a violation of their religious exercise to demonstrate all of the following:
a) that the person's action or refusal to act is motivated by a religious belief;
b) that the religious belief is sincerely held; and
c) that the state action substantially burdens the exercise of religious belief.
6. Allows a person asserting a claim or defense that their religious exercise is burdened to receive injective and declaratory relief.
Basically, it allows business owners and churches to refuse service if rendering service would violate their religious beliefs. Contrary to nearly all news posts on this and other similar bills this is neither a bill that targets homosexuals nor one that endorses or permits discrimination. It merely protects those who could be compelled by law to do something contrary to their faith. It is similar to a Democrat being forced to vote Republican or to promote a Republican candidate, but worse. It is like an Atheist being forced to promote a religion he wholeheartedly opposes. SB 1062 would protect individuals and most organizations from being forced to do something that they consider sin.
Update 2/24/14: I recently discovered that the bill was written by Alliance Defending Freedom
ref.
Update 2/26/14: The governor of Arizona vetoed the bill earlier today, 2/26/14.
