Oral arguments in Obergefell v. Hodges were heard before the U.S. Supreme Court today, 4/28/15.

Questions Addressed

1) Does the Fourteenth Amendment require a state to license a marriage between two people of the same sex?

2) Does the Fourteenth Amendment require a state to recognize a marriage between two people of the same sex when their marriage was lawfully licensed and performed out–of–state?

A total of ninety minutes is allotted for oral argument on Question 1.
A total of one hour is allotted for oral argument on Question 2.

Notable Commentaries



Very enjoyable to read/listen to.  Many great constitutional questions and points are being raised/addressed.  I would propose that for the states to win they would have to win on both questions.  I thought both sides represented their positions very well and the questions asked were good ones as well.

In coming days I will try to post articles that I feel best analyze todays oral testimony.  I have been looking forward to this and the upcoming decision for some time.  I am also interested to see how the upcoming decision will be implemented.

I noticed two mistakes by the justices.  Ginsburg said that divorces were recognized in all states, but that is not true in Texas ref.  A Justice also said that ministers have never been forced to officiate a same sex wedding.  That is not true either and happened recently in Idaho ref.
