request to nullify marriage amendment denied

The case challenging the legality of the California Supreme Court ruling upholding prop 8 was heard today.  A request to nullify California's marriage amendment was denied.  The district court judge is trying to fast track this case to the U.S. Supreme Court. ref.  There will still be a full trial on this case, but U.S. District Court Judge Vaughn R. Walker's goal is to iron out the kinks of the case before it goes to the U.S. Supreme Court.  The primary goal at present is to get both sides to agree on what aspects of the case both sides have no disagreement with and what aspects they do disagree with.  The judge believes it will go to the U.S. Supreme Court regardless.  

This is only the first hearing and the next hearing is scheduled for Aug 19, 2009 ref.
