Judge Walker refuses to stay order

The judge refused to issue a stay of his decision to allow gay marriages until the case has gone through all of the appeals process, however his decision does not go into effect until August 18, 2010 at 5:00pm.

I thought the judge made an interesting, but flawed point though. He seems to think that it is highly unlikely, at best, that the case can be appealed at all since the defendant, Schwarzenegger, refuses to appeal.
ref I say flawed, because if this is the case then this creates a powerful and big loophole for any activist judge to trump any law or amendment no matter how it came to be or how it is worded.
