Man is told by police to remove cross from his yard

Patrick Racaniello of Livingston New Jersey is told by police to remove a cross from his front yard that he put up for Lent. The reasons used by the state was it may distract drivers or because it is on a tree located 8 feet from the curb or because it was on a tree 10 feet from the curb.

ref2. This type of case has already been dealt with by the U.S. Supreme Court in City of Ladue v. Margaret P. Gilleo where the U.S. Supreme Court ruled that such laws violate certain First Amendment rights.

ADF wrote a letter to the township 7/1/11 explaining Racaniello's First Amendment rights and hoped to have a response within 3 weeks of that letter or else the next step would be litigation. On 9/6/11 Livingston added 6 words to their township code to avoid litigation by ADF and Patrick Racaniello.
